These Terms of Service (“Terms”) govern your access to and use of the Foxnut Nutrition website, online store, applications, features, and services (collectively, the “Platform”). The Platform is operated by Foxnut Nutrition (“Foxnut Nutrition”, “we”, “us”, or “our”).
By accessing the Platform, creating an account, placing an order, or otherwise using our services, you agree to these Terms and the policies referred to in them. If you do not agree with these Terms, please do not use the Platform.
We may update these Terms from time to time. Changes will become effective when posted on the Platform. Your continued use of the Platform after an update constitutes acceptance of the revised Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under applicable Indian law to purchase products through the Platform.
If you access the Platform on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.
Our products are currently offered for delivery within India. Customers accessing the Platform from outside India are responsible for complying with applicable local laws.
2. Use of the Platform
You may use the Platform only for lawful purposes and in accordance with these Terms and our applicable policies.
You agree not to misuse the Platform, interfere with its operation, attempt unauthorized access, introduce malicious software, or use the Platform in a way that may harm Foxnut Nutrition, other users, or third parties.
We may suspend or restrict access where we reasonably believe that these Terms or applicable laws have been violated.
3. Product Information
We make reasonable efforts to ensure that product descriptions, ingredients, nutritional information, images, pricing, availability, and other information displayed on the Platform are accurate.
Product packaging, appearance, colour, and other visual details may vary from website images. Images may be provided for illustrative purposes.
Nutritional supplements are intended to complement a balanced diet and healthy lifestyle. Product information on the Platform is not a substitute for professional medical or healthcare advice. Customers should read the product label and recommended usage before consumption.
4. Orders and Acceptance
Products displayed on the Platform constitute an invitation for you to place an order. When you submit an order, you are making an offer to purchase the selected products.
An order is subject to product availability, pricing verification, payment confirmation, and acceptance by Foxnut Nutrition. We may refuse or cancel an order where there is a genuine pricing or product-information error, stock limitation, suspected fraud, or another legitimate reason.
If an order is cancelled after payment has been received, the eligible amount will be refunded through the applicable payment method.
5. Pricing and Offers
Prices, discounts, promotional offers, and product availability may change without prior notice. The applicable price is the amount displayed at checkout at the time the order is placed, subject to correction of genuine errors.
Promotional offers may be subject to additional terms, limited quantities, validity periods, or eligibility conditions. Customers are responsible for checking the applicable terms before completing a purchase.
6. Payment
Available payment methods may include credit cards, debit cards, UPI, net banking, wallets, and Cash on Delivery, subject to availability at checkout.
Online payments are processed through third-party payment gateway providers. Foxnut Nutrition does not ordinarily receive or store complete card credentials such as CVV numbers.
If a payment is unsuccessful or cannot be verified, the order may not be processed until successful payment confirmation is received.
7. Cancellation, Returns and Refunds
Order cancellations, returns, replacements, and refunds are governed by our Cancellation & Refund Policy.
Customers should review that policy before placing an order. Nothing in these Terms limits any rights available to consumers under applicable law.
8. Delivery
Delivery timelines displayed at checkout or in order details are estimates and may vary due to location, courier operations, weather, public holidays, technical issues, or other circumstances beyond our reasonable control.
Orders containing multiple products may arrive in separate shipments. We are not responsible for delays caused by third-party logistics providers or circumstances outside our reasonable control, subject to applicable law.
9. Quantity Restrictions and Resale
We may limit the quantity of products that can be purchased per customer, household, account, payment method, or delivery address, particularly during promotional periods or where stock is limited.
Products purchased through the Platform are intended for personal use unless Foxnut Nutrition has provided prior written authorization for resale. Unauthorized commercial resale, misleading representation, or distribution of our products is prohibited.
10. Account and Customer Information
Where account registration is available, you are responsible for providing accurate information and keeping your login credentials confidential.
You are responsible for activity carried out through your account and should promptly notify us if you believe your account has been accessed without authorization.
Personal information is handled in accordance with our Privacy Policy.
11. Communications
By placing an order, submitting a request, registering an account, or providing contact details, you consent to receive necessary transactional communications relating to your account, orders, payments, delivery, returns, and customer support.
Where permitted by applicable law and subject to your preferences, we may also send promotional communications by email, SMS, WhatsApp, phone, or other electronic channels. You may opt out of promotional communications using the available unsubscribe or preference options.
12. Intellectual Property
All trademarks, logos, brand names, product names, photographs, graphics, text, designs, software, content, and other materials on the Platform are owned by or licensed to Foxnut Nutrition or their respective rights holders.
You may access and use the Platform for personal, non-commercial purposes. You may not reproduce, copy, modify, distribute, sell, publish, transmit, create derivative works from, or commercially exploit Platform content without prior written permission, except where permitted by applicable law.
13. User Reviews and Content
If you submit reviews, comments, photographs, suggestions, feedback, or other content to us, you represent that you have the necessary rights to provide that content and that it does not violate the rights or laws applicable to any third party.
You grant Foxnut Nutrition a non-exclusive, royalty-free, worldwide right to use, reproduce, display, adapt, and publish such content for legitimate business and promotional purposes, subject to applicable law and our Privacy Policy.
We may remove content that is unlawful, misleading, abusive, defamatory, infringing, or otherwise inappropriate.
14. Prohibited Activities
You must not use the Platform to:
• Violate any applicable law or regulation.
• Impersonate another person or entity.
• Upload or transmit viruses, malware, or harmful code.
• Attempt to gain unauthorized access to accounts, systems, or data.
• Scrape, crawl, copy, or systematically extract Platform content without permission.

• Submit false, misleading, fraudulent, or incomplete information.

15. Platform Security
You must not attempt to compromise or bypass the security of the Platform, access information not intended for you, test vulnerabilities without authorization, disrupt services, or use automated tools in a manner that adversely affects the Platform.
We may investigate suspected security violations and take appropriate action, including restricting access and cooperating with lawful authorities where required.

The Platform may use third-party services, including payment processors, logistics providers, analytics providers, communication services, and external websites.
Third-party services may operate under their own terms and privacy policies. Foxnut Nutrition is not responsible for the independent content, policies, availability, or practices of third-party websites or services, except to the extent required by applicable law.
17. Disclaimer of Warranties
To the extent permitted by applicable law, the Platform and its content are provided on an “as available” basis. We make reasonable efforts to maintain accurate information and reliable services but do not guarantee that the Platform will always be uninterrupted, error-free, completely accurate, or continuously available.
Product use should follow the instructions and warnings on the applicable product label. Individual experiences and results may vary.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Foxnut Nutrition will not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of the Platform or products, except where such liability cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Where permitted by law, our aggregate liability relating to a particular order will not exceed the amount paid for the relevant product or the remedy otherwise provided under our applicable policies.
19. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless Foxnut Nutrition, its officers, employees, representatives, and service providers from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Platform, violation of these Terms, infringement of third-party rights, or fraudulent or misleading conduct.
20. Refusal or Suspension of Service
We may suspend, restrict, or terminate access to the Platform or refuse an order where reasonably necessary, including in cases of suspected fraud, misuse, security threats, violation of these Terms, stock limitations, technical problems, or legal requirements.
Any rights or obligations that by their nature should survive termination will continue after termination.

Our collection and use of personal information is governed by our Privacy Policy. By using the Platform, you acknowledge that your information may be processed in accordance with that policy and applicable law.
22. Force Majeure
We will not be responsible for failure or delay in performing obligations where the cause is beyond our reasonable control, including natural disasters, epidemics, government actions, strikes, transportation disruptions, internet or telecommunications failures, payment-system outages, or other comparable events.
23. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be interpreted or replaced to the extent necessary to make it enforceable, while the remaining provisions will continue in effect.
24. Entire Agreement
These Terms, together with the policies expressly referenced on the Platform, constitute the agreement governing your use of the Platform and supersede prior communications relating to the same subject matter, except where additional product-specific terms apply.
25. Governing Law and Dispute Resolution
These Terms are governed by the laws of India.
Any dispute arising from or relating to these Terms or your use of the Platform will first be addressed through good-faith discussions between the parties. If the dispute cannot be resolved amicably, it will be subject to the jurisdiction of the courts having appropriate jurisdiction in India, subject to applicable consumer-protection laws.
Nothing in these Terms prevents a consumer from exercising any statutory rights or remedies available under applicable law.
